Apostille Process for Affidavit – India

There are two commonly followed procedures to get an Affidavit apostilled:

1. Apostille via HRD or State-Level Authentication (Longer Process)

  • Step 1: State-level Authentication
    • Your AMIE certificate is first authenticated by the Department of Higher Education, under the Ministry of Human Resource Development (HRD) or the respective State Home Department, depending on where the certificate was issued.
  • Step 2: Apostille by MEA
    • After authentication from the concerned state or HRD department, the document is sent to the Ministry of External Affairs (MEA) for the final apostille.

This process is often used for countries with strict verification norms and can take longer due to multiple layers of verification.

2. Apostille via Notary & SDM (Faster Process)

This method is widely accepted and offers a much faster turnaround, typically within two working days.

  • Step 1: Notary Public Attestation
    • Your AMIE certificate is notarized by a certified notary public.
  • Step 2: SDM Attestation
    • The notarized certificate is further attested by the Sub-Divisional Magistrate (SDM), New Delhi.
  • Step 3: MEA Apostille
    • Finally, the Ministry of External Affairs apostilles the SDM-attested certificate.

This streamlined method is ideal for most countries that accept apostilles under the Hague Convention framework.

Embassy Attestation for Affidavit

For countries that are not part of the Hague Convention, apostille is not sufficient. Instead, embassy or consulate attestation is mandatory. In such cases, the document must be authenticated by multiple authorities before reaching the foreign embassy.

Embassy Attestation Procedure

  • Step 1: State Authentication or SDM Attestation

    • Depending on the destination country, either state-level HRD/Home Department authentication or SDM attestation is required.

  • Step 2: MEA Attestation

    • Post initial authentication, the certificate is attested by the Ministry of External Affairs (MEA).

  • Step 3: Embassy/Consulate Legalization

    • Lastly, the document is attested by the embassy or consulate of the destination country located in India.

Each embassy may have its own guidelines regarding formats, fees, and turnaround time, which must be checked beforehand.
